Q: If I am covered by Medicaid or Medicare must a hospital bill them for treatment I have received or can the hospital refuse to bill them and assert a lien against any monetary recovery I receive from the insurance of the party at fault for my injuries?

A: Generally, the hospital has the option to bill Medicaid or Medicare, or, in the alternative, assert a lien against the insurance company.  In other words, the hospital has the discretion to choose either course.
