Settlement of Martinsburg car crash

            On September 18, 2007, my client, Ronnie Robinson was operating his vehicle southbound on Raleigh Street in Martinsburg, West Virginia.  Floyd Robinson was a passenger in the same vehicle.  At the same time, Gregory Mills was operating a vehicle insured by UGI/Amerigas and was traveling west on West Martin Street.  Mr. Mills failed to stop at the stop sign on West Martin Street and proceeded through the intersection, and struck the front end of Mr. Robinson’s vehicle.    

            Immediately following the incident, Mr. Robinson was transported by ambulance to City Hospital.  He was treated in the emergency room for neck, back, right leg and right knee pain.  An x-ray performed on his back revealed mild disc disease in the mid and lower thoracic spine. He was discharged from the emergency room with instructions to follow up with treatment at the Veterans’ Memorial Hospital. Mr. Robinson followed up at the VA Hospital in Martinsburg on September 20, 2007 with complaints of ongoing neck, back and knee pain.  He was given medications and told to continue to follow up his treatment.Mr. Robinson was still experiencing pain a week after the accident and sought treatment from Dr. Kerry Bertschinger of Bertschinger Chiropractic Clinic and he began treatment with Dr. Bertschinger on September 26, 2007.  He continued to follow up with the VA Hospital on October 1, 2007, October 2, 2007, and October 31, 2007 Mr. Robinson’s treatment with Dr. Bertschinger consisted of spinal adjustments, ultrasounds, myofascial release and infrared treatments. An MRI was performed on October 13, 2007, at the request of Dr. Kerry Bertschinger, which indicated mild disc disease at C3-4 and C6-7 with a slight canal stenosis at C3-4 and mild left foraminal stenosis at C6-7.  Dr. Bertschinger re-evaluated Mr. Robinson on December 10, 2007 which showed improvement from the chiropractic treatments.  Mr. Robinson continued his chiropractic treatments until he reached maximum chiropractic improvement on February 20, 2008.  He was discharged from treatment with occasional mild discomfort in his neck. The case was settled with the insurance carrier for the at fault driver for an undisclosed amount.
