Liberty Mutual pays client $40,000 for malicious prosecution claim

When our client Michelle Leslie's car was stolen she made a claim with her automobile insurer, Liberty Mutual Insurance. The insurance company initially paid the claim. However, the stolen car was later recovered in Winchester, Virginia and the company reopened its investigation. It eventually accused Ms. Leslie of falsely reporting that her car was stolen. Ms. Leslie was charged with insurance fraud by the Berkeley County Prosecutor's office based upon information provided by the insurance company. The criminal charges were eventually dismissed by the Circuit Court for lack of evidence. We filed suit against Liberty Mutual for malicious prosecution of Ms. Leslie and bad faith insurance practices. The case settled prior to trial for $40,000.
