Former Grant County West Virginia School Superintendent Settles First Amendment Retaliation Claim for $450,000. Marsha Carr-Lambert was the long time Superintendent of the Grant County School System in West Virginia. After she testified during a criminal prosecution of an individual who employed the husband and son of two members of the Grant County School Board and employed a third member of the School Board, the School Board voted three to two not to renew her contract of employment. Ms. Carr-Lambert filed suit against the School Board and the three Board members in the United District Court for the Northern District of West Virginia alleging that the non-renewal of her contract was in retaliation for exercising her First Amendment Right of free expression by giving truthful testimony in a court proceeding. Shortly prior to trial all the defendants settled with the plaintiff by agreeing to pay her $450,000 in damages in exchange for a release from further liability in the matter. Dr. Carr-Lambert was represented by co-counsel Harry Waddell of Waddell Law Offices and David Hammer of Hammer, Ferretti & Schiavoni both of Martinsburg, West Virginia.
