City of Martinsburg pays $100,000 to a woman who fractured lower back as a result of a fall in her basement following sewer back up.

Dixie Hager slipped on water that entered her basement as the result of a sewer system back up.  She fractured her lower back requiring an extended hospitalization at City Hospital in Martinsburg, WV.  She also required nursing home rehabilitation and home health care for several months. Suit was filed against the City of Martinsburg for failure to maintain its sewer system properly. The City initially denied any responsibility but eventually paid $100,000 to Ms. Hager as part of a settlement following mediation.
