Mr. Waddell, working with his friends David M. Hammer and Robert Schiavoni of Hammer, Ferretti & Schiavoni, filed this disability discrimination case for a class of applicants denied full time jobs with the United States Postal Service. When the trial judge denied class certification for the applicants, the trial team filed individual claims for each of the plaintiffs in the United States District Court of the Northern District of West Virginia. Shortly after the first trial was completed, the Postal Service settled all the claims for $500,000.
