$350,000 settlement for failure to diagnose breast cancer

Our client was a married mother of two with a history of breast cancer in her family. She repeatedly when to her family physician for annual checkups including mammograms which were interpreted as normal by the radiologists at City Hospital. The radiologist misdiagnosed questionable findings on mammogram in September 2002 as normal when in fact the findings indicated the presence of breast cancer. The cancer was discovered a year later when it had spread to 19 lymph nodes. Despite aggressive treatment following the discovery of the cancer, the client has recently experienced a recurrence. Expert testimony established that the radiologist violated accepted standards of care in failing to properly read the September 2002 mammogram, and, as a result, the patient's chance for recovery were significantly diminished. The case settled for $350,000 prior to trial.
