Client was a young married woman working in a marketing position who was repeatedly propositioned by her immediate supervisor. The conduct involved unwelcome verbal comments of a graphic sexual nature as well as inappropriate touching. When she complained to the owners of the company about the sexual harassment they failed to to conduct an objective investigation and sought to ignore her complaints. After Waddell Law Offices filed suit against the harasser and the employer based upon the sexually hostile work environment, the employer retaliated against the client and discharged her. The complaint filed in the Circuit Court of Berkeley County, West Virginia was amended to add an additional claim of retaliatory discharge in violation of the West Virginia Human Rights Act. The case eventually settled before trial for a payment of $150,000 to our client.
