$14,750,000 Employment Class Action settlement for 11,000 employees of telemarketing firm

Mr. Waddell, together with four local attorneys, represented 11,000 current and former employees in a class action against telemarketing corporation ICT, Inc. The case, filed in the Circuit Court of Berkeley County, alleged that ICT had systematically cut time from the class members in violation of the West Virginia Wage Payment and Collection Act. The case sought recovery of back pay, liquidated damages under the Wage Act, punitive damages for fraud, and attorney’s fees and costs. Following protracted litigation over six years the case eventually settled for $14,750,000 with all class members receiving a full recovery.
